How discreet can a property sale really be?

A property sale in Luxembourg can stay discreet until signing, not beyond. The listing, the photos, the viewings and the price negotiation can be fully controlled, but the notarial deed is transcribed at the Publicité foncière and, under article 2196 of the Civil Code, anyone can request a copy, price included. Discretion therefore covers the marketing, never the ownership.

What can you keep confidential in a sale?

Everything that comes before signing. No law forces you to publish a listing, put photos online or hang a sign on the façade. An off-market sale rests on exactly this principle: the property is shown to a short list of identified buyers, with no public listing, and the address is only given to those who have proved they are serious.

So you can keep the very intention to sell to yourself, as far as neighbours, colleagues or the wider family are concerned. You can keep back photos of your interior, which often say more about your life than about the property. You can replace the address with a neighbourhood in the first presentation, and reserve the asking price for qualified buyers.

Above all, you avoid leaving a history. In Luxembourg, the gap between asking and sold prices averages 18 % for existing apartments: €9,437 per m² asked against €7,712 per m² signed over the twelve months to the end of June 2026 (data.public.lu). A public listing that drops its price three times becomes information every buyer reads, and uses. A private presentation leaves no such trail.

How do you protect the viewings and the price discussion?

By filtering before you open the door. In a discreet sale, a viewing is a privilege, not a right. A serious buyer accepts to show their financing capacity, with an agreement in principle from a bank or proof of funds, and to sign a confidentiality undertaking before receiving the address and the full file.

Viewings are by appointment, in small numbers, at times agreed with you, with no queue of onlookers on the pavement. The negotiation stays between you, the buyer and the agent: no price circulates on a portal, no counter-offer leaks into the neighbourhood. With 20 to 25 year fixed rates at 3.69 % in August 2026 according to the BCL, most buyers still rely on a mortgage. Checking their financing upfront protects your timetable as much as your discretion.

An honest word on the limit of the exercise: a small circle of buyers also means less competition on price. Discretion costs you when the starting valuation is wrong. It pays off when the price is right and the buyers presented are the right ones.

What necessarily becomes public at signing?

The deed, its price and the names of the parties. In Luxembourg, a property sale must go through a notarial deed, which is then transcribed at the Publicité foncière, in one of the mortgage offices: Luxembourg I, Luxembourg II or Diekirch. Article 2196 of the Civil Code requires the registrars to deliver copies of transcribed deeds "to all who request them". In other words, anyone can, for a fee, obtain a copy of your sale deed, price included (Luther, 2023).

It is not instant. You first have to request the person's record, then the copy of the deed, and query all three offices for a complete picture. But the route exists, and it is the rule. The land register, for its part, lists rights holders parcel by parcel. According to the same note, consulting geoportail.lu and requesting a cadastral extract are free, and an extract can show the owner's name. Access conditions are changing with data protection rules: check them at the time of your sale.

What does stay discreet is the statistics. The Observatoire de l'Habitat and STATEC only publish averages by municipality, canton or size band, never an individual sale (Le Logement en chiffres n°20). Your price feeds the average, it does not appear in plain sight in a table.

Off-market does not mean secret: the marketing can stay invisible, the transcribed deed remains available to anyone who asks for it.

What must the notary know, and can you avoid it?

Everything, and no. The notary is one of the professionals subject to anti-money laundering obligations, like banks, lawyers and estate agents. In practice, the notary identifies the seller, the buyer and, behind a company, the beneficial owner, and looks into the source of funds. The exact rules, in particular limits on cash payments, should be checked with your notary.

See it as protection rather than constraint. A buyer who refuses to justify their funds will not sign, and you are better off knowing it before the third viewing than on the eve of the deed. Discretion covers what the public sees. It never covers what the authorities and professionals have to check.

Signing also has a visible cost. The buyer pays 7 % in registration and transcription duties, 6 % plus 1 %, calculated on the price in the deed. That price is the one that gets transcribed. There is no confidential version of the price for the administration.

Does a company let you stay in the shadows?

Only partly. Since the judgment of the Court of Justice of the European Union of 22 November 2022, general public access to the Register of Beneficial Owners (RBE) has been abolished. The law in force since 1 February 2025 restricts access to national authorities, to professionals subject to anti-money laundering rules, notaries included, and to persons with a legitimate interest, such as journalists or a counterparty checking its partner before a transaction (IFC Review, February 2025).

Holding a property through a company therefore keeps your name out of the RBE for the general public. But the company itself appears in the transcribed deed and in the Trade and Companies Register, and the notary, the bank and the administration know who is behind it. Discreet means not public, not anonymous. Choosing a structure (SCI, SARL, SA) also has heavy tax consequences: decide it with a tax adviser, never for discretion alone.

How do you organise a discreet sale in practice?

Start from a fair price, then control each circle of information. Begin with a valuation based on actual sales, because a property shown privately at the wrong price loses its best buyers without even knowing it. Then agree with your agent who receives what: an anonymous description first, the address and file after financing checks and a confidentiality undertaking, the viewing last. Have the energy performance certificate drawn up from the start: it must be available to buyers from the viewings onwards, even without a listing.

In Luxembourg, no official statistic measures the share of discreet sales. In the UK, the firm Hamptons estimated in 2022 that about one home sold in ten had been marketed without advertising, and nearly one in four in London (PrimeResi). The trend is real wherever sellers have something to protect.

Our fee is 5 % off-market (2 % for a partner agency) and 3 % for a public exclusive mandate if you prefer conventional marketing. This article draws on article 2196 of the Civil Code as presented by the law firm Luther (2023), the RBE law in force since 1 February 2025, Le Logement en chiffres n°20 (Observatoire de l'Habitat and STATEC) and data from data.public.lu. The figures and rules quoted are indicative and do not replace the advice of your notary or tax adviser.

Frequently asked questions

Is an off-market sale legal in Luxembourg?

Yes. No rule requires a listing. Only the notarial deed, its transcription and the energy performance certificate are mandatory, and the certificate must be available to buyers from the viewings onwards.

Can my neighbours find out what my property sold for?

In theory, yes. Article 2196 of the Civil Code allows anyone to request a copy of a deed transcribed at the Publicité foncière, price included. It costs a fee and takes a few steps, but it is open to everyone.

Will my sale price appear in public statistics?

Only in aggregate. The Observatoire de l'Habitat and STATEC publish averages by municipality or size band, such as the €7,712 per m² signed on average for an existing apartment, never an individual sale.

Does buying or selling through a company make the transaction anonymous?

No. Since 1 February 2025 the RBE is no longer open to the general public, but the company appears in the deed and in the trade register, and the notary, the bank and the authorities know the beneficial owner.

How much does a discreet sale with Secretimmo cost?

A 5 % fee off-market (2 % for a partner agency), against 3 % for a public exclusive mandate. The valuation is free if a mandate is signed within a week, otherwise €600 excl. VAT.
