What are off-market properties? Definition, advantages, risks

An off-market property is one sold without a public listing: no portal, no photos online, only identified and vetted buyers. In Luxembourg no statistic measures their share, but in the United Kingdom about one sale in ten was already done this way in 2022, nearly one in four in London. Discretion has real advantages, and a real price: fewer buyers competing, so less price discovery.

What exactly is an off-market property?

A property marketed outside public channels. The seller entrusts the sale to an agent, who presents the property directly to selected buyers, often after they sign a non-disclosure agreement. No listing on the portals, no sign, no open house. The buyers who get to see it have been qualified: clear project, budget, financing.

The phenomenon is well documented elsewhere. According to Hamptons research quoted by PrimeResi, about 1 in 10 homes sold in the UK in 2022 had only been marketed quietly, rising to nearly a quarter in London and prime markets (PrimeResi). In Luxembourg, no source measures this share. Anyone quoting you a national percentage is making it up.

One essential point: off-market does not mean secret. A property sale goes through a notarial deed transcribed at the Publicité foncière, and the Civil Code provides that the registrars deliver a copy of transcribed deeds to anyone who requests it, price included (Luther). The Observatoire de l'Habitat only publishes aggregated prices. What off-market controls is the marketing phase, not the existence of the sale.

Off-market does not mean secret: the deed and its price are transcribed and available on request. What stays discreet is the marketing: no listing, no photos, no history of price cuts.

Why do sellers choose discretion?

To stay in control of three things: their privacy, the pace of viewings and the image of their property. An inheritance, a separation, a move abroad, a high-profile position: many situations sit badly with a listing visible to neighbours, colleagues or sitting tenants.

There is also a price reason. A public listing leaves a trace. According to Immotop, the average asking price in Luxembourg fell 5.0 % year on year in the second quarter of 2026, to €8,111 per m² (Chronicle.lu). In that context, a property whose price drops twice online sends a signal of weakness that every buyer reads. Off the market, a price can be tested with a few buyers without the history becoming public.

Finally, the top end lends itself naturally to it. Belair showed €12,578 per m² in asking prices in the second quarter of 2026, the most expensive district in the capital according to Immotop, and a house sold for an average of €1,372,796 in the canton of Luxembourg according to the Observatoire de l'Habitat. The buyers for this segment exist: Luxembourg has the highest median wealth per adult in the world, €336,498 according to UBS (IndexBox). They are often as discreet as the sellers.

What are the advantages for buyers?

Access ahead of the competition. A buyer who has signed a search mandate receives properties that may never appear online, and views them without a queue. In a market where 1,049 existing apartments changed hands in the second quarter of 2026 (gouvernement.lu), good properties go quickly. Being shown first counts.

The buyer also gains a contact who knows the seller and the file. In return, he or she has to show credentials: identity, financing, source of funds. Estate agents are professionals subject to anti-money-laundering obligations. It is a constraint, but it protects everyone.

What are the real risks of an off-market sale?

The first is price. Fewer buyers competing means less price discovery. With a public listing, several buyers come forward, compare themselves and reveal what the market is ready to pay. Off-market, you risk selling to the first serious buyer at a price nobody challenged. No Luxembourg data quantifies this effect, but the mechanism is real, and we do not hide it.

The second is the valuation. In 2023 the Autorité de la concurrence noted a bidding-up effect, with some agencies winning mandates by quoting prices disconnected from the market (Paperjam). Off the market, the flaw gets worse: without feedback from the public, an overvaluation can stay invisible for months, and an undervaluation never shows.

The third is the intermediary. Everything depends on the quality of their buyer network. Check that the agent holds the estate agent business licence and professional liability insurance: operating without a licence exposes them to criminal penalties (Guichet.lu). The last is cost: off-market fees can be higher than for a conventional sale. At Secretimmo it is 5 % off-market against 3 % for a public exclusive mandate. Better to know before you sign.

How do you limit the risk of selling too cheaply?

By anchoring the price on real sales and building in a way out. Signed prices are published in aggregate: €7,712 per m² for an existing apartment nationally, €10,269 in Luxembourg City against €12,086 advertised. Nationally, the gap between asking and sold prices reaches 18 % (Le Logement en chiffres no. 20). A serious off-market valuation starts from these sales, never from listings.

Next, organise genuine competition, even discreetly: present the property to several qualified buyers at the same time, ask for written offers, set a deadline. Finally, write a clear duration for the discreet phase into the mandate, after which the property can move to public marketing if the offers are not at the right level. Exclusivity, duration and fees are contractual: read these clauses and negotiate them.

Off-market or public listing: how do you choose?

It depends on your property and your priority. Off-market suits prestige properties, properties with an obvious buyer profile, sensitive situations and sellers who prefer discretion to the last euro. A public listing often remains the best option for a standard apartment in an active market, when maximum competition between buyers is the goal. And nothing stops you from combining the two: start discreetly, then open up to the public. The reverse is harder, because a property already seen everywhere does not become confidential again.

Frequently asked questions

What does off-market mean in real estate?

A property sold without a public listing: no portal, no photos online. The agent presents it directly to selected and vetted buyers, often under a non-disclosure agreement.

Does an off-market sale stay confidential?

The marketing does. The sale itself does not: the notarial deed is transcribed at the Publicité foncière and the Civil Code allows anyone to request a copy, price included.

Do you sell for less off-market?

That is the main risk: with fewer buyers competing, price discovery is weaker. No Luxembourg data quantifies it. You limit it with a valuation based on real sales, several written offers and a deadline.

How much does an off-market sale with Secretimmo cost?

5 % off-market (2 % via a partner agency), against 3 % for a public exclusive mandate. The on-site valuation is free if a mandate is signed within the week, otherwise it costs €600 excl. VAT.

What share of sales is off-market in Luxembourg?

No statistic measures it in Luxembourg. In the UK, Hamptons research estimated that about 1 in 10 homes sold in 2022 had only been marketed quietly, nearly a quarter in London.
